Who Can File a Wrongful Death Lawsuit in Maryland

Maryland’s Wrongful Death Act (Md. Code Ann., Cts. & Jud. Proc. § 3-904) defines who may bring a claim and how long families have to file.

Primary beneficiaries who may file are the surviving spouse, parent, or child of the deceased. Secondary beneficiaries, relatives by blood or marriage who were substantially dependent on the deceased, may file only when no primary beneficiaries exist.

The statute of limitations under § 3-904(g)(1) is three years from the date of death. Missing this deadline may permanently bar your family’s right to seek compensation. One important distinction: a wrongful death claim is an independent cause of action. It can be filed within three years of death even if the decedent’s own personal injury claim would have been time-barred.

Damages Available in a Maryland Wrongful Death Case

Maryland law allows surviving families to pursue two categories of damages, and the estate may separately pursue a survival action.

  • Economic damages include final medical expenses, funeral and burial costs, lost wages and earning capacity, and the loss of financial support the deceased would have provided. There is no cap on economic damages in Maryland wrongful death cases.
  • Non-economic damages cover loss of companionship, loss of parental care, and the emotional suffering of surviving family members. Maryland applies an annually adjusting cap on non-economic damages; consult an attorney for the current figure.

Maryland also recognizes a separate survival action, which allows the deceased’s estate to pursue damages for pain and suffering the decedent experienced between injury and death. The distinction matters: wrongful death compensates the family; a survival action compensates the estate. Both can be filed alongside each other.

Maryland’s contributory negligence rule adds a critical dimension. If the decedent is found to bear any percentage of fault, recovery may be barred entirely. Thorough investigation from the outset isn’t just helpful. Under this rule, it’s essential.
