Drowning Accidents WE ARE READY TO HELP

Drowning Accident Attorney in Baltimore

Personal Attention After a Fatal or Nonfatal Water Accident

A drowning or near-drowning can cause death, oxygen-deprivation brain injury, spinal injury, or lifelong medical needs. Determining whether someone is legally responsible may require examining what happened in the water, who controlled the property, which safety measures were in place, and whether a preventable hazard contributed to the incident.

At Miller Stern Lawyers LLC, we handle personal injury litigation for clients in Baltimore and throughout Maryland. Our drowning accident attorneys evaluate potential liability, serious injuries, insurance issues, and the legal options available to injured people and surviving families.

Where Swimming Pool & Water Accidents Happen

The setting can shape a potential claim because maintenance duties, access controls, and supervision vary by property. Water-related injuries may occur at private homes, apartment or condominium complexes, hotels, gyms, recreation centers, parks, public pools, waterfront properties, or during boating and other water activities.

Conditions that may warrant closer legal review include:

  • Inadequate barriers: Missing fencing, unsecured gates, or other access-control problems
  • Unsafe pool conditions: Dangerous diving areas, poor maintenance, or hazardous design
  • Insufficient supervision: Missing or inattentive oversight where supervision was required
  • Defective equipment: Problems involving drains, flotation devices, pool components, or safety equipment
  • Delayed response: Failures involving emergency procedures or available rescue measures

A pool incident doesn’t have to be fatal to support a potential claim. Near-drowning injuries, falls, diving injuries, entrapment, and other serious harm may also raise questions about negligence and legal responsibility.

Liability in Baltimore Drowning & Swimming Pool Claims

A negligence claim generally requires evidence that a party owed a duty of care, failed to meet that duty, caused the incident, and caused legally recognized harm. The applicable duty depends on factors such as why the injured person was on the property, who controlled the setting, and how the injury occurred.

Premises Liability

Premises liability concerns the responsibility of those who own, occupy, operate, or control property. A claim involving a pool may require reviewing barriers, warnings, maintenance, water conditions, access, and supervision. Responsibility isn’t necessarily limited to the property owner if another person or entity operated or maintained the location.

Product Liability

A defective drain, pool component, flotation device, or other product may raise product liability issues separate from concerns about the property itself. Whether a viable claim exists depends on the product, its condition, its role in the incident, and the available evidence.

Wrongful Death

When a drowning is fatal, eligible family members may have rights under Maryland wrongful death law. Any available claims will depend on the family relationship, circumstances of the death, potentially responsible parties, and other case-specific factors.

Compensation After a Drowning or Near-Drowning

The losses associated with a water-related injury may continue long after the initial emergency. Depending on the evidence and Maryland law, recoverable damages may include emergency treatment, hospitalization, rehabilitation, and future medical care. A claim may also account for lost income, reduced earning capacity, disability, and pain and suffering.

A fatal incident may create distinct losses for eligible family members, including lost financial support and losses associated with the death. The types and value of damages available depend on the injuries, insurance coverage, evidence, responsible parties, and applicable law.

Our broader litigation practice includes catastrophic injuries and wrongful death issues. Across that practice, our attorneys have contributed to settlements and verdicts collectively worth hundreds of millions of dollars. Past results don’t determine the outcome of a particular case.

Maryland Pool Safety Standards & Filing Deadlines

Safety codes may help establish which requirements applied to a property at the time of an incident. Maryland’s swimming pool and spa standards adopt the 2024 International Swimming Pool and Spa Code for pools and spas connected to building permit applications received on or after December 31, 2023, subject to stated exceptions.

Maryland also requires counties and municipalities that own or operate swimming pools to maintain an automated external defibrillator program. Each covered pool must have an onsite automated external defibrillator and a trained individual present.

Maryland generally requires civil actions to be filed within three years after accrual, meaning the point at which a claim legally arises, unless another law provides a different deadline. Wrongful death actions generally must be filed within three years after death. The correct deadline may vary based on government involvement, the defendant, the injured person’s age, and other facts. Families shouldn’t assume every case has the same filing period.
