Methodical Preparation from Negotiation Through Trial
Our boutique-firm structure gives clients the involvement of an entire legal team. Every team member actively participates in each case, allowing us to examine the evidence, legal issues, and opposing positions from multiple perspectives while maintaining personal communication with the client.
We emphasize methodical trial preparation and focused negotiation. Preparing a claim means developing the evidence, applying the governing law, and anticipating opposing arguments. Even when a case may settle, thorough preparation supports informed decisions during negotiations and positions it for trial if the parties can’t agree.
Our legal professionals have successfully represented thousands of clients and contributed to settlements and verdicts collectively worth hundreds of millions of dollars. One listed result is a settlement of more than $12 million in a medical malpractice case involving a failure to diagnose. Past outcomes reflect the work performed in those cases but don’t predict what may happen in another claim.
Injury, Malpractice, Securities & Other Claims We Handle
We evaluate what happened and then examine the evidence, legal duties, and potentially responsible parties. Our representation spans several distinct types of disputes.
Our practice areas include:
- Personal injury litigation
- Medical malpractice
- Birth defects litigation
- Securities litigation
- Environmental law
- Catholic Church sexual abuse matters
Our injury work includes claims arising from auto accidents, truck accidents, motorcycle accidents, boat accidents, bicycle and pedestrian accidents, and elder abuse. We examine how the incident occurred, what injuries or losses followed, and which people or entities may bear legal responsibility.
Malpractice and birth defects cases may involve detailed medical records and questions about professional duties. Securities disputes concern investor harm and conduct involving financial interests. Environmental law and Catholic Church sexual abuse matters present different factual and legal issues, so each requires an evaluation tailored to the events and evidence.
How a Civil Claim Moves Forward
A claim typically starts with an initial consultation and a review of the available facts and documents. This discussion allows a prospective client to describe what happened, identify relevant records, and ask about possible legal options.
A case may then proceed through several stages:
- Investigation: Gathering records, evaluating evidence, and identifying potentially responsible parties.
- Demand or filing: Presenting a demand for resolution or filing a lawsuit when appropriate under the circumstances.
- Civil discovery: Exchanging information and evidence relevant to the dispute, which may include written questions, document requests, and testimony.
- Resolution or trial: Negotiating a settlement or presenting the case at trial when the parties don’t reach an agreement.
Not every claim follows the same path. The time required depends on the complexity of the evidence, the number of parties, and the court’s schedule. Throughout the process, we keep clients informed about developments, upcoming decisions, and the status of their cases.
Maryland Deadlines & Rules That May Affect a Claim
Legal deadlines can determine whether a claim may proceed. A statute of limitations sets the deadline for filing a lawsuit. Under Maryland Courts and Judicial Proceedings Section 5-101, the general limitations period for injury actions is three years from the date the claim accrues, although the accrual date and any exceptions depend on the facts.
Malpractice claims generally must be filed by the earlier of five years from the date of injury or three years from the date the injury was discovered. Applying these periods can involve case-specific questions about when an injury occurred or became discoverable. Waiting to seek an evaluation can make it harder to preserve records and assess the controlling deadline.
Additional rules may affect injury litigation in Maryland:
- Contributory negligence: Maryland follows a strict rule under which even minor negligence by an injured person can completely bar recovery of damages, even when another party was also at fault.
- Government claim notices: Claims involving Maryland state or local government entities generally require written notice within one year of the injury, subject to the governing law and facts.
- Court assignment: Lawsuits seeking $30,000 or less generally proceed in Maryland District Court, while claims exceeding $30,000 generally proceed in Circuit Court.
These are general rules, not conclusions about a particular case. The type of claim, damages sought, and applicable notice provisions can affect filing requirements and where litigation proceeds.
